LML parent company sues Bajaj Auto over trademark 'Freedom' branding for motorbikes

The company emphasised that Bajaj’s use of the "Freedom" mark is a direct infringement.

SG Corporate Mobility, the parent company of LML, has filed a lawsuit against Bajaj Auto Ltd. before the Delhi High Court. The suit alleges unauthorised use of the trademark "Freedom" on Bajaj's newly launched Bajaj Freedom CNG motorbikes, asserting that such use violates SG Corporate's trademark rights and tarnishes the established reputation of the LML Freedom brand.

The company stated in a media release that LML initially introduced the "Freedom" motorbikes to the Indian market in 2002. These bikes quickly garnered a reputation for their durability, style, and performance. The success and lasting trust in LML Freedom remain evident today, with many of the bikes still seen on Indian roads. In 2021, LML Ltd. assigned the trademarks "LML" and "Freedom," along with their associated goodwill, to SG Corporate Mobility Pvt. Ltd.

Revitalising 'Freedom' brand

SG Corporate Mobility is committed to protecting the "Freedom" trademark and aims to revitalise the brand through its sister concern, LML Emotion Pvt. Ltd. Since acquiring the trademarks, SG Corporate Mobility has actively prepared to re-enter the two-wheeler market. In 2022, they announced a strategic collaboration with Saera Electric Auto, the former manufacturer of Harley Davidson motorcycles in India, utilizing Saera's facility in Bawal, Haryana, the company said.

The company emphasised that Bajaj’s use of the "Freedom" mark is a direct infringement.

"According to SG Corporate Mobility, Bajaj’s use of the 'Freedom' mark on its motorcycles violates its statutory trademark rights and dilutes the established reputation which is associated with LML Freedom motorbikes."

This lawsuit is part of their comprehensive strategy to revive and protect these iconic names. The case is currently pending before the Delhi High Court.

SG Corporate Mobility Ltd. is being represented by the law firm Anand And Anand, with Advocate Pravin Anand, Advocate Jaya Negi, and Advocate Yashi Agrawal handling the case.
